Ousted Nairobi Governor Mike Sonko has been shaking the judiciary corridors in the past few days as he releases tapes of alleged corruption cases involving judges, lawyers and State House foes.
“As a new page of impunity turns today in the history of Nairobi, this is just a trailer of a five-part series exposing the rot in the Kenyan Judiciary to be aired in various media local and international platforms. The series is a mixture of corrupt and fraudulent land dealings, my impeachment, sex for justice escapades and succession cases where widows, widowers, orphans and investors have been denied justice, as evident by the actions of Honourable Justice Juma Saidi Chitembwe and some of his fellow learned judges who have conspired to deny me justice by facilitating the hurried swearing in of the incoming Governor.” Sonko said of his tapes.
Keeping to his threats, Sonko has released audio of telephone conversation between Amana Saidi Jirani, nominee and brother to Honourable Justice Juma Saidi Chitembwe and Lawyer Cecil Miller whom he claims was instrumental in influencing the judgement upholding his un procedural removal from office.
Miller in the audio clip was in touch with Saidi Jirani who’s the brother to Justice Chitembwe, he was to broker a deal for Justice Muchelule who was handling a case he was pursuing to release an order for freeing funds held by the court.
According to the recorded conversation, Miller had Sh57million withheld by the court for years and wanted a quick intervention for the release. According to Sonko, Miller had coerced unnamed widow into depositing Sh53M cash with the court in what he says is fake taxation case.
Miller negotiated a bribe of Sh7M for Justice Muchelule to give favorable order for the funds, Chitembwe was tasked to talk to Muchelule with Jirani being the intermediary.
While blaming Miller for his tribulations, Sonko aired audio where Justice Chitembwe’s brother Saidi in conversation with Miller, wabted to secure a meeting with the President after he claimed that Sonko had made peace with Uhuru.
Miller in the case, was working with a statehouse official George Kariuki together with Majority leader Abdi Guyo in influencing his case before Justice Chitembwe.
Disturbingly, Miller was previously representing Sonko in his corruption cases before jumping the ship and working against him a former client.
Publicly, Miller is yet to comment on the tapes while Justice Chitembwe has come out to refute the fraud claims saying the videos are faked.
Speaking to KTN’s Sophia Wanuna on Wednesday night, the judge who was linked to bribery, said the former county boss was unhappy that his petition challenging Anne Kananu’s swearing in did not sail through.
“It is not a coincidence that the videos are released on the day of Anne Kananu’s swearing-in. He was angry the petition did not go through. He is on record asking why I dismissed the case yet I am his uncle. The videos were released out of anger,” he said.
Chitembwe also claimed that the videos leaked by Sonko on his social media platforms on Tuesday were edited to malign his image.
He alleged that he knew about the existence of the said videos in July.
“I have no problem. Let the videos go round because they are edited to fit a particular narrative. Some parts have been left. I knew about the existence of the videos in July and it was just a matter of when they would be out,” he stated.
Asked whether the man soliciting for a bribe on his behalf is indeed his brother, the judge said: “That man is not my brother, not my uncle and our parents are not related. However, I have known him for over 10 years because we both come from Kwale.”
